시행일: 2026년 7월 14일 제1조 (목적) 본 약관은 TOMATO(토마토, 이하 "서비스")가 제공하는 텍사스 홀덤 학습·연습용 모바일 애플리케이션 및 관련 서비스의 이용 조건과 절차, 이용자와 운영자의 권리·의무를 정합니다. 제2조 (서비스의 성격) 1. 서비스는 텍사스 홀덤을 학습하고 연습하기 위한 트레이너입니다. 퀴즈, AI 토너먼트 시뮬레이션, 핸드 복기, 성장 대시보드 등을 제공합니다. 2. 서비스에서 사용되는 칩은 학습·연습을 위한 가상의 값이며, 실제 금전이 오가는 도박이 아닙니다. 서비스는 현금·상품으로 환전되는 도박을 제공하지 않습니다. 3. 서비스는 AI 코치 '토미'를 제공합니다. 토미는 사람이 아니라 AI이며, 그 조언·해설은 학습 참고용입니다. 제3조 (계정 및 이용) 1. 서비스는 별도의 회원가입 없이 이용할 수 있으며, AI 분석·구독 확인을 위해 익명 식별자를 사용합니다. 2. 이용자는 스토어(App Store·Google Play)의 연령 등급 정책에 따라 서비스를 이용합니다. 제4조 (AI 분석 및 동의) 1. 복기 AI 분석 기능은 입력한 핸드 기록을 제3자 AI 서비스(Anthropic)에 전송하여 처리합니다(개인정보처리방침 참고). 2. 이 전송은 이용자의 명시적 동의가 있는 경우에만 이루어지며, 동의는 앱 설정에서 언제든지 철회할 수 있습니다. 제5조 (구독) 1. Premium 구독은 Apple App Store / Google Play의 인앱 결제로 제공되는 자동 갱신 구독입니다. 2. 구독은 현재 기간 종료 24시간 전까지 취소하지 않으면 동일 조건으로 자동 갱신되며, 갱신·해지는 스토어 계정 설정에서 관리합니다. 3. 결제는 이용자의 스토어 계정으로 청구됩니다. 제6조 (이용자의 의무 — 금지 행위) 이용자는 다음 행위를 해서는 안 됩니다. 1. 서비스의 역설계·무단 복제·부정 조작 또는 시스템 악용 2. 서비스 운영을 방해하거나 타인의 이용을 방해하는 행위 3. 관련 법령 또는 스토어 정책에 위반되는 행위 제7조 (데이터 삭제) 1. 기기 내 저장 데이터(프로필·기록·복기·설정)는 앱을 삭제하면 함께 삭제됩니다. 2. 익명 식별자·구독 기록 등 서버측 데이터의 삭제는 문의 이메일로 요청할 수 있습니다(데이터 삭제 안내 참고). 제8조 (서비스의 변경·중단) 운영자는 서비스 내용을 변경하거나, 운영·기술상 필요에 따라 서비스의 일부 또는 전부를 중단할 수 있습니다. 제9조 (면책) 1. 토미(AI)의 해설·조언 및 서비스가 제시하는 전략·확률은 학습 참고용이며, 실제 포커 게임의 결과나 수익을 보장하지 않습니다. 2. 서비스는 실제 금전 도박을 조장하지 않으며, 이용자가 서비스 외부에서 행한 도박의 결과에 대해 책임지지 않습니다. 3. 운영자는 이용자의 서비스 이용으로 발생한 손해에 대해 책임지지 않습니다. 단, 운영자의 고의·중과실은 예외로 합니다. 제10조 (문의) 서비스 관련 문의: tomato@weareoven.com

Purpose These terms govern the conditions of use and the rights and duties of users and the operator of TOMATO (the "Service"), a Texas Hold'em learning and practice app. 2. Nature of the Service 1. The Service is a trainer for learning and practicing Texas Hold'em, offering quizzes, AI tournament simulation, hand review, and a growth dashboard. 2. Chips used in the Service are virtual values for learning and practice only; the Service is not real-money gambling and provides no gambling exchangeable for cash or goods. 3. The Service provides an AI coach, "Tomi." Tomi is an AI, not a person, and its advice/explanations are for learning reference only. 3. Account & Use 1. The Service can be used without sign-up; an anonymous identifier is used for AI analysis and subscription checks. 2. Use is subject to the age-rating policies of the App Store / Google Play. 4. AI Analysis & Consent 1. The hand-review AI analysis feature sends your hand records to a third-party AI service (Anthropic) for processing (see the Privacy Policy). 2. This transfer occurs only with your explicit consent, which you can withdraw anytime in Settings. 5. Subscription 1. Premium is an auto-renewing subscription offered via Apple App Store / Google Play in-app purchase. 2. It renews automatically on the same terms unless canceled at least 24 hours before the end of the current period; renewal and cancellation are managed in your store account settings. 3. Charges are billed to your store account. 6. User Duties (Prohibited Conduct) You must not: (1) reverse-engineer, copy, tamper with, or abuse the Service; (2) disrupt the Service or interfere with others' use; (3) act in violation of applicable law or store policies. 7. Data Deletion 1. On-device data (profile, records, reviews, settings) is deleted when you delete the app. 2. Deletion of server-side data (anonymous identifier, subscription records) can be requested by email (see the Data Deletion page). 8. Changes / Suspension The operator may change or suspend all or part of the Service for operational or technical reasons. 9. Disclaimer 1. Tomi (AI) explanations/advice and the strategies/odds shown are for learning reference only and do not guarantee outcomes or profit in actual poker. 2. The Service does not promote real-money gambling and is not liable for the results of gambling a user engages in outside the Service. 3.
